Abstract

This paper is aimed at describing the history and the social dynamics of the reformist and traditionalist fiqh in Indonesia. It first tries to show that since the 13th century Islam in Indonesia has largely been Sufi-oriented. It was only fairly recently that Islam in this country came into contact with figh especially after the return of Indonesian students from the Middle East toward the end of the 19th century. The puritan and reformist movements that prevailed in the Middle East at the time especially those under the patronage of Muhammad Abdul Wahhab and Jamaluddin al-Afghani inspired Muslims of this country to launch a similar reform in Indonesia. This reform movement received a somewhat strong opposition from the traditionalists since the beginning of the 20th century, hence the tension between the two currents of thought. This paper pays particular attention to this dynamic tension in the context of the contemporary historical and legal development in Indonesia.

Abstract

To make connection between fiqih and humanism is often judged as a subversive. Religion is convinced the only source of morality, then rationality tendency to discover morality – such as humanism - never get a proportional place. Whereas at a certain point religioun is meaned totalitarianly by his follower, there’s potency to exploit religion for political and partisan interest that will kill humanistic values. In this context, the existence of religion is important to be reflected in a humanization process, namely a process to place and treat human being more human. From the above frame work, this assignment will explain the Abou El Fadl’s conception of humanistic fiqih related to pluralism, democracy, and social justice. These three conceptions are “par excellence” humanistic values that often being campaigned by Abou El Fadl. Abou El Fadl is a scholar who has great attention to establish link between Islam, fiqih and morality.

Abstract

The esoteric nature of Indonesian Islam during the 15th – 17th centuries makes it possible for the debate on eschatological issues including the idea of death to flourish. Abdurrauf Singkel was among the Sufis to have lived in this dynamic century and was engaged in the debate on the issue of death. This paper is aimed at discussing his views about death particularly by referring to his Lubb al-Kashf wa al-Bayan. We discover that Singkel’s treatment of death is related to such concepts of body, soul, salvation and human desire. We also find out that his views found a logical consonance with that of the Javanese manuscript called Serat Wirid idajat Djatinamun. Here human desire and destiny is symbolized in color; red symbolizes human’s anger, black his evil deeds, yellow his mystical attitude, and white his happiness and inner tranquility. The basic argument of the two books is that control of one’s desire during his/her lifetime will help determine his/her destiny in life to come.

Abstract

The idea of Islamic state and leadership has long been a subject of debate. But it remains intriguing to ask once and again what does Islamic state mean and what is its real and true nature? What does leadership mean and does Islam really need politics? This paper is designed mainly to answer these important questions. It will trace the ideal form of politics in Islam by investigating the formulas promulgated by the ulama over centuries. Two notions will be the focus of this investigation. First is the notion of how a leader should be elected, and second is the problem of what are the conditions of the leader. These two interrelated problems are at the centre of the idea of leadership in Islam. We argue that by understanding them one would necessarily be able to grasp the “Islamic” formula of statehood and politics.

Abstract

For the real intellectuals, truth is a search, a journey, a couse, an endeavor. They believe that truth can only be attained through series of painstaking process. The autobiographies of al-Ghazâlî and Sardar are fine illustrations of this kind of search for thruth. Although al-Ghazâlî and Sardar are separated by ten centuries, one can find clear parallels in antomy and procedures of their journeys in seeking truth. The present author attempts to analyse these autobiographies and shows why they could be a good example for young intellectuals.

Abstract

Gender discourse does present particular problems within Muslim societies mainly for three reasons, (1) the strong presence of patriarchal culture within Muslim society (2) the strong literal tendency in interpreting religious texts, and (3) the strong sense of animosity toward the Western culture. There is a few however among Muslims in Indonesia who are willing to negotiate with gender issues not as a discourse but as a practical principles that should rather be applied in our daily life. For this group of people patriarchal culture and literal interpretation of religious texts are problematic. This group thinks that the idea of gender equality is an inherent part of Islam and must therefore be accepted. Among this few is the students of Ma’had Aly in the East Javanese town of Situbondo. These students are concerned with implementation issues of gender equality rather than with debating this problem as a discourse. This paper explores the ideas of these students and relates them with the general debate that takes place on the national level concerning the issue of gender equality.

Abstract

This paper deals with the problem of child protection from an Islamic perspective. It starts by discussing the Islamic teaching concerning family values and the function of family in child education as well as the responsibility of the family in protecting the children. By extension the paper is also concerned with the idea of marriage, its meaning and function in social life. We base our analysis on the Qur’ânic verses but also on the child protection law number 23 year 2002. We basically argue that it is up to the family to raise the children in a positive or negative manner. The very structure of family is very much relevant to the upbringing of the children and that their positive or negative attitude is dependent upon the nature of the surrounding in which they live.

Abstract

Modern science requires that dialectic between induction and deduction should take place so that development of knowledge and its promotion may be acquired. In modern sciences in other words, such dialectic constitutes the very condition for the creation and invention of new theories, discoveries and fields of knowledge. This paper is trying to argue that as a science, fiqh in one way or another has appropriated a similar route of using these two methods of induction and deduction in its process to extrapolate religious laws and rules.We argue that in fiqh induction produces norms that may serve as the foundation for the deductive method. We contend that induction is a general rule extracted directly from the first source of Islamic law, namely revelation, whereas deduction is the legal principles (alqawa’id al-fiqhiyyah) that the ulama formulated on the basis of their understanding on the contents of revelation.

Abstract

This paper is aimed at discussing the notion of endowment as a means to increase the economic prosperity of the Muslim society in Indonesia. It argues that the Muslims of Indonesia have enough endowed properties but lack a proper management in running them. This leads to the misuse of the properties on the one hand, and to the failure to achieve the proposed aims for which these properties are endowed. This paper suggests ways to run the properties properly and the reasonable objectives for which the endowment may be aimed at.

Abstract

The texts of the Qur’ân may be understood as a collection of symbols, and cannot be interpreted in isolation from the context as their background. If semiotics is a science of symbols, then the texts of the Qur’ân must be the fertile object for the study of semiotics. In the science of semiotics, texts are deemed to have no end in themselves, meaning that we must not acknowledge them as having ended or being finalized at some point. Some philosophers such as Jacques Derrida have underscored this, and maintained that language is a metaphor. A meaning that we assume resulted from our use of language is in fact the product of the metaphorical exchange. Hence, a meaning will change as soon as the subject of the metaphorical exchange changes. Meaning in other words is both dynamic and relational because it is based on an endless source.
